David Celestin United States Terms of Use
Local Supplement to the Global Terms of Use
These United States Terms of Use (“US Terms”) apply to your access to and use of the DAVIDCELESTIN.COM United States sub-site (the “US Site” or the “David Celestin United States Site”). They supplement the Global Terms of Use and govern in the event of a conflict, as described in the Global Terms’ “Order of Precedence” section. Please read the Global Terms of Use alongside these US Terms.
Acceptance of Terms
By accessing or using the US Site, you agree to be bound by these US Terms together with the Global Terms of Use. If you do not agree, please do not use the US Site.
Use of the US Site
The following features are available on the US Site: Store, Blog, Fora, Studiolab, Newsletters, Podcasts, Tools, and Articles. Each operates as described in the Global Terms of Use, subject to the US-specific provisions below.
Store
Purchases made through the US Site Store are in U.S. dollars (USD) and are subject to the Purchase, Refund and Return Policy published on the US Site. Consumers in the United States retain all rights afforded under applicable federal and state consumer protection laws, including but not limited to the Federal Trade Commission Act and applicable state deceptive trade practices statutes. Sales tax will be calculated and applied based on your shipping or billing address in accordance with applicable state and local law.
Fora
Enrollment in courses through the US David Celestin Fora is subject to the enrollment terms posted on the US Site. Where applicable, cancellation and cooling-off rights follow relevant FTC rules (such as the FTC’s “cooling-off” rule for certain sales) and any applicable state-level equivalents.
Studiolab
Consulting and services engagements originating through the US Site are governed by separate service agreements issued by the David Celestin US entity or its designated affiliate.
Newsletters
Newsletter communications sent to US subscribers comply with the CAN-SPAM Act. Every commercial email will include a clear way to unsubscribe, and requests to unsubscribe will be honored promptly.
Tools
Tools made available on the US Site are provided “as is.” To the extent permitted under applicable law, we disclaim all warranties regarding their accuracy or reliability.
Articles
Articles on the US Site may reference affiliate or partner deals. In accordance with FTC guidance on endorsements and testimonials, material connections with partners will be disclosed where applicable.
Privacy Policy
Use of the US Site is governed by our Privacy Policy, including any US-specific supplement addressing applicable state privacy laws (such as the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and other state privacy statutes as applicable). Limitation of Liability
To the maximum extent permitted by applicable law, DAVIDCELESTIN.COM, its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the US Site. Dispute Resolution, Governing Law
These US Terms and any dispute arising from your use of the US Site are governed by the laws of the state in which DAVIDCELESTIN.COM’s US operating entity is organized (or another state as designated on the US Site), without regard to conflict-of-laws principles. Any dispute not subject to small claims court will be resolved through binding individual arbitration, and you and DAVIDCELESTIN.COM each waive the right to participate in a class action, to the extent permitted by applicable law. Venue for any matters not subject to arbitration will lie in the state or federal courts located in the jurisdiction designated on the US Site.
Compliance with US Law
You agree to use the US Site in accordance with all applicable U.S. federal, state, and local laws and regulations.
Changes to These US Terms
We may update these US Terms from time to time. Material changes will be posted on the US Site with an updated effective date.
